Legal advice?

A friend of mine, who is working at a Care Home, is keeping his own diary on how he is getting on with his job. The other day he came out saying he was a little bit scared because one of the guys he is working with told him he should not be writing this diary at all and that it was against the law to do so. He also said he had completed a report on a client at home (on his own computer, but never printed it off) because they asked him to do it right before he was about to finish with his shift. Apparently, due to some data protection law they told him he is going against the law about all of this. He never took home any records from the Care Home he is working at, not did he comment on this diary to anybody apart from his boss and supervisor. Is my friend really going against the law?

It all depends on the information he is recording and on what he uses it for.



If he is just keeping a personal record of his daily activities and the care and treatment he is giving to various patients then there should be no problem, however it would be better if he did not state the names of the people he is treating due to this being personal medical data and therefore in some ways sensitive.



It is in fact both a sensible and professional practise to keep note in such employment, much as a police would, and therefore there should be no complaint about his activities.
